Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and JobStoryVault ("Company," "we," "us," or "our"), governing your access to and use of the JobStoryVault platform, including all associated websites, applications, features, and services (collectively, the "Services") available at jobstoryvault.com. By creating an account, accessing, or using the Services in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Services.

The Services are intended solely for individuals who are 18 years of age or older. By using the Services, you represent and warrant that: • You are at least 18 years of age; • You have the legal capacity to enter into a binding contract in your jurisdiction; • You are not prohibited from using the Services under applicable law; and • All information you provide to us is accurate, current, and complete. JobStoryVault does not knowingly collect or solicit personal information from anyone under the age of 18. If we learn that a user under 18 has created an account, we will terminate that account and delete all associated data promptly. If you believe a minor has registered, please contact us at the address in Section 19.

3.1 Account Creation To access most features of the Services, you must register for an account. You agree to provide accurate, complete, and current information during registration and to keep that information up to date. 3.2 Account Security You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to use a strong, unique password, notify us immediately at support@jobstoryvault.com of any unauthorized use, and not share your credentials with any third party. JobStoryVault is not liable for any loss or damage arising from your failure to maintain the security of your account. 3.3 One Account Per User Each user may maintain only one active personal account. Creating multiple accounts to circumvent usage limits, suspensions, or other restrictions is prohibited.

JobStoryVault is an AI-powered career intelligence platform that transforms fragmented work history into a persistent, structured professional profile ("Career Profile"). The Services include, without limitation: • Career Dump: Free-text input tool that ingests your work history in unstructured form; • AI Profiling: Automated extraction and analysis of skills, career themes, accomplishments, and professional competencies; • Resume Builder & Tailoring: Tools to create, optimize, and tailor resume documents to specific job descriptions; • Job Match & Application Tracking: Tools to identify relevant opportunities and track application activity; • Career Intelligence Features: Skill gap analysis, ATS optimization, cover letter generation, career timeline visualization, and related AI-assisted tools. Feature availability varies by subscription tier as described in Section 5. We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice where practicable. Important: JobStoryVault provides career intelligence tools for informational and organizational purposes only. Nothing in the Services constitutes legal, financial, employment, or professional career advice. You are solely responsible for all career decisions you make.

5.1 Plan Tiers JobStoryVault offers the following subscription tiers: • Free Tier: Access to core features at no cost, subject to usage limits; • Pro Tier: Enhanced features available for a monthly or annual fee; and • Career Intelligence Tier: Advanced features and higher usage limits for a monthly or annual fee. 5.2 Billing & Renewal Paid subscriptions are billed in advance on a monthly or annual basis. Subscriptions automatically renew unless you cancel before the renewal date. All fees are charged in U.S. dollars and are non-refundable except as required by applicable law. 5.3 Cancellation You may cancel your paid subscription at any time through your account Settings page. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for unused portions of a billing period. 5.4 Free Trial We may offer free trials of paid tiers from time to time. At the end of a free trial, your account will automatically convert to the selected paid tier unless you cancel before the trial ends. 5.5 Price Changes We reserve the right to change subscription pricing. We will provide at least 30 days' advance notice of any price increase to existing subscribers.

6.1 Ownership You retain full ownership of all career data, work history, documents, and other content you submit to the Services ("User Content"). JobStoryVault does not claim ownership of your User Content. 6.2 License to JobStoryVault By submitting User Content, you grant JobStoryVault a limited, non-exclusive, worldwide, royalty-free license to access, process, store, and use your User Content solely for the purpose of providing and improving the Services to you. 6.3 Accuracy of User Content You represent and warrant that all User Content you submit is accurate to the best of your knowledge and does not infringe any third-party rights, violate any law, or misrepresent your professional qualifications. 6.4 Data Export You may export your Career Profile and generated documents at any time through the Services.

7.1 AI Processing of Your Data JobStoryVault uses artificial intelligence and machine learning to analyze your User Content and generate career intelligence outputs. This processing is performed to deliver the Services you have requested. 7.2 No AI Training on Your Personal Data We will not use your identifiable personal data or User Content to train or fine-tune JobStoryVault's AI models without your explicit, separate opt-in consent. Furthermore, our third-party AI sub-processors (such as OpenAI or Anthropic) are contractually prohibited from using your User Content to train their foundational models. 7.3 Your Right to Use Your Own Data Freely You are free to use, export, and process your own career data however you choose - including submitting it to third-party AI tools, services, or platforms. 7.4 Anonymized & Aggregate Data We may collect, analyze, and use de-identified, anonymized, and aggregated data for improving our Services, generating research, and sharing with research partners or third parties for commercial purposes. Aggregate Data does not identify you personally.

8.1 Permitted Use You may use the Services solely for lawful personal career management, professional development, and job search purposes. 8.2 Prohibited Conduct You agree not to: • Submit false, misleading, or fraudulent information about your work history or credentials; • Use the Services to create profiles on behalf of others without their consent; • Scrape or systematically extract data from the Services using automated means; • Reverse engineer or attempt to extract source code or underlying algorithms; • Attempt to gain unauthorized access to other users' accounts or data; • Resell or commercially exploit the Services without express written consent; • Use our AI features to generate content that violates applicable law or infringes third-party intellectual property; or • Violate any applicable local, state, national, or international law or regulation. Violation of these prohibitions may result in immediate account suspension or termination without notice or refund.

9.1 JobStoryVault Property The Services, including all software, algorithms, AI models, designs, logos, and content created by JobStoryVault ("Platform Content"), are owned by or licensed to JobStoryVault and are protected by applicable intellectual property laws. 9.2 Limited License to You Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial career management purposes. 9.3 Feedback If you submit suggestions or feedback about the Services, you grant JobStoryVault a perpetual, irrevocable, royalty-free license to use and incorporate that Feedback without any obligation of compensation. 9.4 AI-Generated Outputs Documents and analyses generated by the Services using your User Content are provided for your personal use. You own the Generated Outputs you create, subject to the license granted in Section 6.2. We make no representations regarding the copyrightability of AI-generated outputs under applicable law.

The Services may allow you to import data from or connect with third-party services (such as LinkedIn). Your use of any third-party service is subject to that service's own terms and privacy policy. JobStoryVault is not responsible for the content, policies, or practices of any third-party service. By importing third-party content (such as a LinkedIn PDF export), you represent and warrant that you are authorized to import and use that content within the Services, and that you have obtained this data in compliance with the third-party platform's terms of service. You agree not to use prohibited software, scrapers, or crawlers to extract data from third-party platforms in violation of their user agreements.

11.1 Termination by You You may close your account at any time through your account Settings page or by contacting us at support@jobstoryvault.com. 11.2 Termination by JobStoryVault We reserve the right to suspend or terminate your account if we determine you have violated these Terms or engaged in fraudulent activity. 11.3 Effect of Termination - Data Handling Upon account termination: • Your personal data, User Content, and Career Profile will be permanently deleted from our active systems within 30 days; • We will retain anonymized and de-identified aggregate data; • Backup copies may persist in secure archival storage for up to 90 days before permanent deletion; and • We will retain records required by law (e.g., billing records) for the period required by applicable law.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JOBSTORYVAULT DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Specific AI Disclaimers: JobStoryVault utilizes generative AI. You acknowledge that AI-generated outputs (including resume summaries, skill extractions, and match scores) are probabilistic and may contain inaccuracies, hallucinations, or outdated information. You are solely responsible for reviewing, verifying, and editing all AI-generated content before relying on it or submitting it to employers. JobStoryVault does not guarantee that use of the Services will result in employment, interviews, or career advancement.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOBSTORYVAULT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR EMPLOYMENT OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. AI Liability Cap: We expressly disclaim any liability for business losses, missed employment opportunities, or reputational harm arising from your reliance on unverified AI-generated content produced by our Services. In no event shall JobStoryVault's total aggregate liability to you exceed the greater of: (a) the total amount you paid to JobStoryVault in the twelve (12) months preceding the claim; or (b) one hundred U.S. dollars ($100.00).

You agree to defend, indemnify, and hold harmless JobStoryVault and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third party's rights, including claims arising from your unauthorized extraction or scraping of data from third-party platforms.

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court. 15.1 Informal Resolution First Before initiating any formal dispute, you agree to contact us at support@jobstoryvault.com and describe your dispute. We will attempt in good faith to resolve it informally within 30 days. 15.2 Binding Arbitration Except for excluded disputes, any dispute arising out of or relating to these Terms shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. 15.3 Waiver of Class Actions You and JobStoryVault each agree that any dispute resolution proceeding will be conducted only on an individual basis - not in a class, consolidated, or representative action. 15.4 Excluded Disputes Claims for injunctive relief, claims within small claims court jurisdiction, and disputes that applicable law requires to be resolved in court are excluded from mandatory arbitration. 15.5 Opt-Out Right You may opt out of this arbitration agreement by sending written notice to legal@jobstoryvault.com within 30 days of first accepting these Terms.

These Terms and any disputes not subject to arbitration shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

JobStoryVault is committed to digital accessibility. We strive to maintain our platform in accordance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards to ensure our Services are accessible to all users. If you experience any accessibility barriers while using our platform, please contact us at support@jobstoryvault.com so we can assist you.

We may update these Terms from time to time. When we make material changes, we will post the updated Terms with a new "Last Updated" date and provide at least 30 days' advance notice to registered users via email or in-app notification. Your continued use of the Services after the effective date constitutes your acceptance of the changes.
